NCP leader Nawab Malik stated on Friday that the legislature, not the Maharashtra government, decided to suspend 12 BJP MLAs. He also stated that the Legislative Secretariat would perform a review on the legislature's authority and the court order, with the Speaker of the Legislative Assembly making the final decision.
"Once the Supreme Court's written order is available, the speaker of the legislative assembly will make a decision. The speaker, not the administration, made the decision to suspend 12
BJP legislators." The Maharashtra Assembly's secretariat would analyse the Supreme Court order before the speaker makes a decision, he said. The Maharashtra Assembly's secretariat would analyse the Supreme Court order before the speaker makes a decision, he said.
Meanwhile, Devendra Fadnavis, a prominent BJP leader, praised the Supreme Court's decision on Friday, calling the suspension of 12 BJP MLAs from the Maharashtra Legislative Assembly "unconstitutional" and "irrational." The apex court's ruling is "another stiff slap" in the face of the Maha Vikas Aghadi (MVA) administration of Shiv Sena, NCP, and Congress for its "unconstitutional, unethical, unjust, unlawful, and undemocratic conduct," according to the Maharashtra Assembly's Leader of Opposition.
The Supreme Court ruled on Friday that a resolution suspending the 12 BJP MLAs for the balance of the July 2021 session is "unconstitutional" and "irrational." The supreme court handed down its decision on the 12 legislators' appeals of their one-year suspension from the state legislature.
They were removed from the Assembly on July 5 last year after the state government accused them of misbehaving in the Speaker's chamber with presiding officer Bhaskar Jadhav. In a tweet in response to the Supreme Court's decision, Fadnavis said, "Satyameva Jayate (Satyameva Jayate) we applaud and appreciate the Supreme Court for overturning the suspension of our 12 BJP Maharashtra MLAs during the monsoon session, who were battling for the rights of OBCs in the Maharashtra Legislative Assembly." Sanjay Kute, Abhimanyu Pawar, Girish Mahajan, Atul Bhatkhalkar, Parag Alavani, Harish Pimpale, Yogesh Sagar, Jay Kumar Rawal, Narayan Kuche, Ram Satpute, and Bunty Bhangdia were among those suspended, in addition to Ashish Shelar, the BJP's chief whip in the Assembly.
