The Speaker, Mr. Rahul Narwekar, made the announcement that the question regarding the alleged Teachers' Eligibility Test (TET) would be withheld for lack of sufficient details after the opposition strongly objected to the response by the School Education Minister, Mr. Deepak Kesarkar. This caused great embarrassment for the ruling alliance. The Speaker's decision to prevent discussion of the alleged TET fraud on the grounds that it is sub judice resulted in raucous scenes in the state parliament.
Chief of the opposition The Speaker cannot prevent debate because the case is still pending, according to Mr. Ajit Pawar,
NCP MLAs Mr. Dilip Wales-Patil, Mr. Jayant Patil, Mr. Chhagan Bhujbal, and Mr. Jitendra Awhad, as well as Congress MLAs Mr. Nana Patole and Mr. Ashok Chavan. They cited rulebooks and earlier instances to support their claim that the assembly is supreme and that discussion is permitted even though the case is still pending.
The legislative secretariat has withdrawn two of the seven overall queries that Mr. Pawar had raised in this regard, Mr. Pawar informed the Speaker. Mr. Narwekar promised that it would be investigated and that anybody found guilty would face punishment. Mr. Pawar wanted to know which ministers, MLAs, and officials' children passed the test and how many people were prosecuted for misconduct. Although no names were named in the parliament, the TET scam involved Agriculture Minister Abdul Sattar. He has, however, denied using the TET fraud to his daughters' advantage.
As the case is still under investigation, Mr. Kesarkar informed the house that it would not be proper for him to comment. The opposition objected, claiming that the legislature is supreme and that it cannot address any matter while a case is still pending. Former assembly speaker Mr. Walse-Patil noted that despite the Karnataka assembly making a resolution on this subject, the Maharashtra-Karnataka border dispute is still pending before the supreme court. "Even now, we are talking about it. Do you mean we shouldn't talk? "He queried.
