Court: No evidence was provided by the Prosecution against Chhagan Bhujpal and his Kin
The Nationalist Congress Party (NCP) leader Chhagan Bhujpal along with seven other members were discharged by a special Anti-Corruption Bureau (ACB) court. This decision came after taking the material available on record and hearing to both sides. It was required to hold that the prosecution had not made out a prima facie case against Chhagan Bhujpal, his son, nephew, Public Work Department (PWD) and many more.

This is a case that took place in the year 2005 when Chhagan Bhujpal was the Public Works Department (PWD) Minister, who is claimed to have given a contract without even inviting tenders to KS Chamankar Enterprises. In 2015, when the Bombay High Court observed that prima facie evidence was available and the Anti-Corruption Bureau (ACB) can file a case of corruption, the Anti-Corruption Bureau (ACB) registered a case against 11 people, stating that a developer was helped for a project where an RTO land in Andheri was to be handed over a project in lieu of construction to the tune of 100 crores at Maharashtra Sadan in Delhi and RTO building in Tardeo.

The court had earlier discharged five people under this allegation which were Arun Deodhar, Krishna Chamankar, Pravina Chamankar, Pranita Chamankar and Prasanna Chamankar. The court in its letter wrote that the whole incident was a contract with the state government and the Developer. As it was the contract between two parties who negotiated according to their interest forgetting the terms and conditions of the Contract. Further, it stated, that at this point of time while charging the accused further, it is very necessary to find sufficient grounds. The requirement is the court’s satisfaction with all the materials available and should not act as a judge but should consider the evidence and based on that form an opinion.
