Nawab Malik, a Maharashtra Minister who was arrested last week, petitioned the Bombay High Court on Monday to have the case against him dismissed by the Enforcement Directorate (ED), which is investigating money laundering links to fugitive Underworld don Dawood Ibrahim.Malik is currently in the ED's custody till March 3rd.
The
Nationalist Congress Party leader submitted a petition at the high court on Monday, asking the court to dismiss the case as well as the special court's ruling remanding him in the ED's custody. He said that his detention was "illegal" and that he was singled out because he was a "vocal opponent of the misuse of federal agencies."
The petitioner noted that he is not the only person to be targeted and that this is a troubling pattern across the country in which the government agencies are being abused by the ruling party. Malik demanded that he be released from ED detention immediately and that his arrest be declared unconstitutional by the Supreme Court.
On Tuesday, the appeal for an urgent hearing is expected to be cited. Malik said in his appeal that ED agents forcibly removed him from his home on February 23 without warning or summons, citing section 41A of the Criminal Procedure Code. The minister further noted that the special court authorized to hear charges under the Prevention of Money Laundering Act (PMLA) had no authority on February 23.
According to the ED, Malik plotted a criminal conspiracy with Dawood Ibrahim's associates - Haseena Parker, Salim Patel, and Sardar Khan - to steal the ancestral property of one Munira Plumber in Kurla, Mumbai, which is worth over Rs 300 crore. As a result, the federal anti-money laundering agency said it was profits of crime. The National Institute of Justice had filed a criminal complaint under the Unlawful Activities Prevention Act (UAPA).
