In response to
NCP leader Nawab Malik's appeal for a 6-week release for surgery due to a renal condition, the Enforcement Directorate (ED) stated that by pleading guilty, he is attempting to avoid the clutches of the law. It went on to say that there is no need for relief for the sole purpose of receiving medical treatment in government hospitals. Its response stated that surgery and medical therapy can be performed while in detention under the supervision of medical officials or at a government hospital.
Malik had sought treatment at a private hospital of his choice as an alternative to being granted interim bail. According to the ED, he is attempting to circumvent the legal system by requesting this relief. It is possible that he will be able to remain at large under the guise of long-term health concerns in conjunction with the hospital of his choice, according to the report. It went on to say that JJ hospital is a well-equipped government health facility and that the plea is "nothing but a strategy" to seek bail.
In his plea, Malik also mentioned an accused person's fundamental rights. The ED stated that the patient's fundamental rights have been safeguarded, and that treatment does not have to be provided by a facility of his choosing. Malik's counsel, Kushal Mor, told the court on Monday that his health had deteriorated over the previous three days and that he had been admitted to JJ hospital at noon, where he was wheeled in. Mor informed the court that Malik was suffering from fever, shaking and vomiting and that he needed to be transferred to a private hospital since JJ Hospital lacked the necessary testing equipment.
The court has requested a report from JJ Hospital on Malik's medical condition, as well as the availability of a facility to undertake the tests required to treat him. Malik's daughter should also be allowed to visit him in the hospital, according to the lawyer. Nilofar Khan, his daughter, was allowed to meet him according to hospital schedules.
