The MVA Government has withdrawn the order to demolish Union Minister Narayan Rane's residence in Juhu

The Maharashtra Government on Tuesday informed the Bombay High Court that it has decided to withdraw the notice issued for demolishing certain allegedly illegal elements in Union Minister Narayan Rane's luxury eight-story home in Juhu. The state, on the other hand, has stated that all claims in the case must be kept open.
 
Rane filed a lawsuit disputing the notice on the grounds of claimed illegal constructions and breach of the Coastal Regulation Zone (CRZ), which was dismissed by a bench of Justices Amjad Sayed and Makarand Karnik. On March 21, the Sub-Divisional Officer (SDO, Western Suburbs) had issued a demolition notice through the District Collector.
 
Rane said in his plea that he has been dwelling in the bungalow because he owns shares in Kaalkaa Real Estate. The notification, however, was issued in the name of Artline Properties Private Limited, which merged with Kaalkaa in 2017 after National Company Law Tribunal instructions (NCLT).
 
The warning demanded that Rane correct the illegal structures by March 28 or the officer will dismantle them himself. The District Coastal Zone Management Committee, according to Rane, does not have the authority to issue such a notice because it is based on a government regulation (GR) from 2011. The minister said that the GR does not apply to concerns concerning buildings, which are governed only by the BMC. He also claimed that he was not given a chance to be heard.
 
"The state's actions are clearly in violation of my fundamental rights, as well as the rights of its shareholders and beneficial owners, as enshrined in Articles 14 and 21 of the Constitution, and are thus liable to be set aside." "The contested order was issued in  flagrant disregard of natural justice standards," Rane opined. The State Government's Advocate General, Ashutosh Kumbhakoni, presented a statement before the bench on Tuesday, requesting that the notice be withdrawn.
 
"Reserving the right to take action if and when it is deemed necessary, albeit the March 21 order is hereby rescinded in conformity with the law." "All contentions of all parties to the present proceedings be expressly maintained open for consideration if and when such action is taken," the AG argued in front of the bench.
