The Maharashtra administration will appeal to the Supreme Court against the suspension placed on local body elections in the state on seats with up to 27% OBC reservation. Maharashtra Food and Civil Supplies Minister Chhagan Bhujbal said yesterday that the state government will petition the Supreme Court to have all seats in local governments, including those reserved for OBCs, contested or postponed.

The Supreme Court is likely to hear the case on December 13, according to him. Bhujbal and senior state government officials met with senior counsel Mukul Rohatgi, who will represent the state government in the case. He urged that the state government argue in the Supreme Court that empirical data from the socio-economic and caste census be made public.

The Supreme Court had stated that the election procedure for the remaining seats will go on. The Maharashtra State Election Commission announced on Tuesday that elections for ZPs and Panchayat Samitis on all seats save those reserved for OBCs will be held as scheduled on December 21 in response to the Supreme Court's direction.

Over 400 of the 1,200 seats set aside for OBCs would now have to wait for the Supreme Court's next decisions. "The state administration is resolved not to upset the scheduled caste and scheduled tribal reservation," Bhujbal added, referring to the triple test advocated by the Supreme Court before. Second, it has promised not to exceed the 50% reservation threshold. The third test, which is still ongoing, was to offer empirical data on OBC."
