Maharashtra SEC says no change in reservation for local by-polls
After the Chief Minister Uddhav Thackeray led Maha Vikas Aghadi (MVA) Government declared an ordinance for providing reservation to Other Backward Classes (OBC) in the approaching local body elections without breaking the 50 percent capacity, it seems to not to be applicable for the by-polls announced by the state election commission (SEC) going to be held in six Zilla Parishad on October 5.
 
In a statement, State Elections Commissioner UPS Madan stated that the elections are taking place as per the directives given by the Supreme Court and that too with open category. If any changes have to be made in the category, that decision will be of the Apex court only.  
 
This statement indicates that the trouble Maha Vikas Aghadi (MVA) Government was facing due to the Other Backward Classes (OBC) reservation has not been over and it will need to again knock the doors of the Apex Court in this regard. “If there is any change that needs to take place for the by-polls, it will only be done by the law and orders from the Supreme Court as they have directed to hold the elections based on open category candidates.
 
In case of any change, the directions will come from whom the decision was made. We cannot change the directives on our own,” stated Madan indicating that the Maharashtra Government will have to approach the Supreme Court for the reservation being implemented. Further, he also stated that the state government should also take a legal opinion to make sure if the ordinance applies for the approaching local body elections or not,” he stated.
