BMC sends destruction notice in suspension for structures close to Hancock flyover

Mumbai: Brihanmumbai Municipal Council has informed the Bombay High Court in April BMC gives 27 notice to demolish some structures to complete the construction of the Hancock flyover with the prior permission of the court.  The assurance came after a petition was filed by Sangram Singh and several others challenging the demolition notice.  The order was issued more than 10 days after the full bench order of the High Court. 
 
May 7 and extending the order until June 30.  Chief Justice Dipankar Dutta, before the bench, said the illegal structures impeded the completion of a project of public importance.  The petitioners contended that Girish Kulkarni BMC Corporator was in contempt of the court and should issue an appropriate order in the interest of the applicants. The notice dated April 27, 2021, was issued in defiance of the order of the full bench dated April 16, 2021 lawyer submitted by lawyer Oorja Dhond .
 
The police had informed the BMC that they could not assist with such demolition given the full bench order, so the BMC decided to postpone the demolition. The court directed that the BMC lawyer not take further action as per the notice on the instructions of Assistant Commissioner Makrand Dagadkhair of the ‘E’ ward. 
 
However, the High Court granted BMC the freedom to seek such permission by submitting an appropriate application and will not prevent them from producing relevant material and/or evidence before the competent authority of the Corporation approved.
