After the Bombay High Court asked the Brihanmumbai Municipal Corporation to stop the operation of a wholesale fish market at a building in South Mumbai which has been proclaimed to be in a risky condition, the Brihanmumbai Municipal Corporation has put forward a plan of action to move the traders. 
 
In the petition the Brihanmumbai Municipal Corporation stated that the traders will not be permitted to set foot in the Chhatrapati Shivaji Maharaj Fish Market – a wholesale fish market residing near Mahatma Jyotiba Phule Market or Crawford Market from July 11 as the building will be bulldozed and rebuilt. 
 
A PIL was inclined by a division bench of Chief Justice Dipankar Datta and Justice Girish S Kulkarni on July 6 filed by Asagar Abbas Shaikh, who is a fish merchant, by the advocates Rajiv Narula and MA Khan, asking the Brihanmumbai Municipal Corporation to shift the market to Airoli temporarily. 
 
The petition states that in 2016 the upper floors of the building were destroyed but the fish market continued to work. On June 30, the bench declared that the Brihanmumbai Municipal Corporation will have to take all the required authority and responsibility if the ceiling falls in which can harm the lives of many. And in happening like this the officers of the corporation will expose themselves to civil and criminal liability. The Bombay High Court has asked the Brihanmumbai Municipal Corporation to present an affidavit to keep their plan of action to shift the fish traders from the South Mumbai market. 
 
“The traders are at liberty to trade at Airoli Octroi Naka plot or in any other markets of the corporation as per the availability. The plan that has been taken immediately is permitting trade in temporary ground floor shed, the construction of which will resume after the demolition of the existing building,” said Senior Counsel Anil Sakhare, on behalf of the BMC.
