The Shiv Sena-UBT is facing a new concern more than seven months after the split since Uddhav Thackeray's five-year term as party leader is set to expire on January 23. Anil Desai, a Sena-UBT member, claimed that the party has written to the Election Commission requesting permission to hold organisational elections, including for the position of President and members of its national executive.

Shiv Sena-UBT and the Balasahebanchi Shiv Sena are currently embroiled in a contentious battle before the EC over the party name (the original "Shiv Sena") and its recognisable symbol as a result of their split in June (bow and arrow). Due to various circumstances, the ECI granted the two factions new names and emblems in October 2022; the BSS had two swords and a shield as its symbol while the Shiv Sena-UBT had a flaming torch.
